1. Introduction
Welcome to CloudPixelSphere ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht rental services and our website available at cloudpixelsphere.sbs (the "Service"), operated by CloudPixelSphere.
By reserving a charter or using our Service, you consent to comply with these Terms. Should you reject any section of the terms, you are not permitted to use the Service.
2. Service Overview
CloudPixelSphere offers exclusive yacht chartering services that include but are not limited to:
- Yacht hires for the day
- Evening sailings
- Business getaways
- Private gatherings
- Extended charter trips
Service availability depends on various factors, and we retain the authority to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
In order to secure a charter, you must:
- Be a minimum of 18 years old
- Provide valid and comprehensive details
- Transfer the necessary deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed booking is only established upon our receipt of payment and our issuance of written confirmation. We retain the right to deny service to anyone at our discretion.
3.3 Availability
Charter availability is contingent on the availability of vessels and acceptable weather conditions. Efforts will be made to accommodate your requested dates and timings whenever feasible.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and include all relevant taxes unless specifically noted. Prices are susceptible to alteration without prior notification.
4.2 Payment Schedule
- Deposit: Half of the total cost of the charter due at the time of booking
- Full balance: Due two days before the scheduled departure of the charter
- Incidental expenses (if any): Payable at the end of the charter
4.3 Payment Methods
We accept most credit cards, bank money transfers, and certified bank drafts. Secure, encrypted processing systems manage our payment transactions.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus any transaction fees
- Between 24 and 72 hours before departure: Refund of 50%
- Within 24 hours of departure: No refund is provided
5.2 Weather Cancellations
If unsafe weather conditions are determined by our captain, we will propose to:
- Schedule your charter for the next possible date with no extra charge
- Offer a complete refund if rescheduling is not feasible
5.3 Mechanical Issues
Should there be mechanical troubles with the designated vessel, we will strive to provide an appropriate alternative. In the absence of an alternative, a full repayment will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to instructions from the crew
- Wear any safety gear when necessary
- Disclose any health conditions that may impact their security
- Stay within the allocated areas on the watercraft
6.2 Prohibited Items
Items not allowed on board include the following:
- Containers made of glass
- Illegal substances
- Firearms or any form of weapons
- An excess of non-alcoholic beverages (beyond a reasonable quantity for consumption)
- Pets (unless they have received prior authorization)
6.3 Conduct
Patrons are expected to behave respectfully. Should a passenger's conduct present a danger to safety or interfere with others' experiences, we have the authority to terminate the charter prematurely without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter fees paid. We are not accountable for:
- Injuries incurred due to passenger carelessness
- The loss or harm of personal items
- Indirect damages or punitive losses
- Delays stemming from weather or other circumstances beyond our control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained by us, covering both our vessels and business operations. It is recommended that passengers arrange their own travel and personal insurance.
7.3 Assumption of Risk
Participating in our charter services signifies your recognition of the inherent risks in maritime activities and your acceptance of the responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Itineraries, courses, or timetables may be altered by us due to factors like weather conditions, safety concerns, or operational needs. We shall endeavour to provide comparable alternatives where possible.
9. Force Majeure
No liability shall be assumed by us for postponements, cancellations, or modifications due to situations beyond our control, including but not limited to:
- Extreme weather patterns
- Natural calamities
- Government directives
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal data in compliance with our Privacy Policy. Your use of our services indicates agreement with the collection and application of your information as detailed in the Privacy Policy.
11. Intellectual Property
Our website content, including literary compositions, images, emblems, and visuals, is protected under copyright and trademark legislation. Unauthorized reproduction, distribution, or the creation of derivative forms without our express permission is prohibited.
12. Governing Law
The laws of Portugal govern these Terms. Any disputes are to be settled in the courts located in Cascais, Portugal.
13. Changes to Terms
At any moment, we reserve the prerogative to adjust these Terms. Notice of alterations will be broadcasted on our website with a revised date of modification. The continued use of our services signifies acceptance of the updated terms.
